Terms of Use

These terms govern your access to and use of the Blackflake website. Commercial engagements with Blackflake — pilots, licences, implementation services — are governed by separately negotiated agreements and are not regulated by this page.

These terms apply to visitors to blackflake.com and its subdomains (the "Website"). By accessing the Website you accept these terms. If you do not accept them, please do not use the Website.

02Operator

The Website is operated by Bennovate sp. z o.o., trading as Blackflake. Full entity details are on the Legal Notice page.

03Acceptable use

You may view, print, and link to pages for personal or business-research purposes. You may not:

  • Use any content from the Website in a way that would be misleading or likely to damage Bennovate or its brand partners.
  • Scrape, frame, or systematically harvest content beyond what the robots policy permits.
  • Attempt to probe, scan, or circumvent the Website's security beyond the scope defined on the Security page.
  • Use the Website or any address or resource linked from it to send spam, malware, or unlawful content.

04Intellectual property

All content on the Website — including text, imagery, logos, typography, layouts, source code, and the "Blackflake", "Avantwerk", "Greyfork", and "Bennovate" marks — is owned by or licensed to Bennovate sp. z o.o. and is protected by Polish, EU, and UK intellectual-property law.

You may not reproduce, distribute, modify, or create derivative works from the Website's content for commercial purposes without written consent from Bennovate sp. z o.o. Requests: legal@blackflake.com.

05Website content

Information published on the Website is for general informational purposes. It is not professional advice (legal, medical, financial, or otherwise). While we endeavour to keep information accurate and up to date, we make no representation or warranty of any kind regarding accuracy, completeness, or fitness for a particular purpose.

Statements regarding product capabilities, outcomes, projected results, or research findings are illustrative. Numbers shown are labelled by their observation date or by the word "projected" where they reflect modelling rather than audited measurement. Individual results depend on context, data quality, and deployment specifics and are not guaranteed.

06AI content

Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law, including consumer-protection law, liability for death or personal injury caused by negligence, or liability for fraudulent misrepresentation.

Liability in relation to any Blackflake product, pilot, or implementation engagement is governed by the separate agreement signed for that engagement. These Website terms do not modify those agreements.

10Law & jurisdiction

These terms and your use of the Website are governed by the laws of Poland, without regard to conflict-of-law rules. Any dispute arising from or in connection with these terms is subject to the exclusive jurisdiction of the courts in Łódź, Poland.

This clause is without prejudice to mandatory consumer-protection rights you may have under the laws of your country of residence in the EU or the UK.

11Changes

We may update these terms. The "Version" and "Effective" dates above reflect the current version. Your continued use of the Website after an update constitutes acceptance of the updated terms.
